According to NBC, Judge Carl Irace also accused Burke Jr of making “irresponsible” comments and threatened a gag order. He reportedly suspended the license because Timberlake refused to take a breathalyzer test, the report said.

He later dropped the dismissal motion, according to reports.

Timberlake was given a new, mock trial date of Friday, August 2, magistrate court representatives told Patch. He participated in the court proceedings effectively that day.
Burke had originally filed a motion to dismiss the case “with an insufficient indictment” — because the original charging document did not have a sergeant's signature, he said.
In a statement, the DA's office said: “Following Justin Timberlake's arrest, the DA's Office identified a clerical error in the original indictment. Subsequently, on July 2, 2024, an amended indictment was filed that corrects this error. The facts and the circumstances of the case have not been changed or modified.”
The DA's office added, “We are prepared to litigate the underlying facts of this case in court and not in the press.”
In a statement, Burke said: “The most important fact to know about this case is that Justin was not drunk and should not have been arrested for DWI. The police made a number of very important mistakes in this case .In court today, you heard the prosecutor correct one of those mistakes, and there are many more, and this is just one of those incidents. He cooperated with the police at all times and treated them with the respect they deserve .
According to a Sag Harbor Village police spokesperson, Timberlake, 43, was arrested in the “early morning hours” of June 18 on a DWI charge and taken away.
Sag Harbor police said that at 12:37 a.m. Timberlake, Tennessee, was seen driving a 2025 BMW southbound on Madison Street and failing to stop at a properly posted stop sign and failing to maintain his lane.
A Sag Harbor Village police officer initiated a traffic stop and, upon investigation, determined that Timberlake was driving under the influence. He was arrested, processed and held overnight for morning arraignment, police said, the same protocol as any other DWI arrest.
Timberlake was arraigned in Sag Harbor Village Justice Court and released on his own recognizance, police said.
Burke released a statement after he was arrested and charged with driving while intoxicated in Sag Harbor.
“I look forward to vigorously defending Mr. Timberlake on these allegations,” Burke said. “I will have more to say at the appropriate time, but right now I am awaiting full discovery from the DA's office.”

Timberlake was released without bond, Burke said.
Court documents revealed that Timberlake told police, “I had a martini and followed my friends home.”
Timberlake's criminal complaint read: “His eyes were bloodshot and glassy, a strong odor of an alcoholic beverage came from his breath, he was unable to divide attention, had slurred speech, was unsteady and did not perform well. on all standardized field sobriety tests.”
NBC reported that Timberlake had dined at the iconic American Hotel and was headed to a friend's house when police arrested him. The friend's identity has not yet been released.
A representative for Timberlake could not immediately be reached.
